By accessing and using Domana ("the Service"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and Domana, Inc. ("Domana," "we," "us," or "our").
You must be at least 18 years of age to create an account and use Domana. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Domana provides an AI-powered property management and maintenance intelligence platform. Our Service includes:
Free Trial: All new accounts receive a 60-day free trial with full access to the features of your selected plan. No payment is required during the trial period. You will be notified before your trial expires.
Subscription Plans: Domana offers tiered subscription plans for residential and commercial properties. Plan details, pricing, and feature inclusions are displayed at the time of sign-up and within the app. Commercial properties may require custom onboarding and pricing determined through a sales consultation.
Auto-Renewal: After your 60-day free trial ends, your subscription will automatically renew at the applicable rate for your selected plan. Subscriptions renew on a recurring basis (monthly or annually, depending on your selection) until cancelled. You will be charged through your Apple App Store account. The renewal charge will be applied within 24 hours prior to the end of the current billing period.
Price Changes: We may change subscription prices from time to time. Any price changes will take effect at the start of the next billing period following notice to you. Your continued use of the Service after a price change constitutes your agreement to the new price.
Cancellation: You may cancel your subscription at any time through your Apple App Store account settings or by contacting us at admin@domana.ai. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for.
Refund Policy: If you are unsatisfied with the Service, you may request a full refund within 7 days of being charged. Refund requests made after 7 days from the charge date will not be eligible for a refund. To request a refund, contact us at admin@domana.ai with your account details and reason for the request. Refunds for purchases made through the Apple App Store are subject to Apple's refund policies and may need to be processed through Apple.
Free Trial Cancellation: You may cancel during the free trial period at any time without being charged. If you do not cancel before the trial expires, your selected subscription plan will begin and you will be charged accordingly.
Program Name: Domana Vendor Notifications
Description: Transactional service job notifications sent to authorized vendors containing appointment details, property addresses, and tracking links.
Message Frequency: Varies based on scheduled service jobs. Vendors receive one SMS per assigned job.
Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier.

You retain full ownership of all property data, documents, photos, and other content you upload to Domana ("User Content"). By uploading User Content, you grant Domana a limited, non-exclusive, royalty-free license to use, process, store, and display your User Content solely for the purpose of providing and improving the Service. This includes processing your documents and data through AI services to extract information, generate maintenance schedules, and provide property intelligence insights. This license terminates when you delete your User Content or your account.
Domana uses artificial intelligence to generate maintenance schedules, equipment recommendations, property intelligence insights, and extracted document data. You acknowledge and agree that:
The Service integrates with and may contain links to third-party services, including but not limited to Google Cloud, Google Gemini AI, Twilio, and the Apple App Store. These third-party services are governed by their own terms and privacy policies. Domana is not responsible for the content, practices, or availability of third-party services. Your use of third-party services is at your own risk.
Domana and its original content, features, functionality, branding, and technology are owned by Domana, Inc. and are protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOMANA, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO DOMANA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Domana, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Aurora, Colorado. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
We reserve the right to suspend or terminate your account at any time for violations of these Terms, with or without notice. You may terminate your account at any time by contacting admin@domana.ai or through the app settings. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, indemnification, and dispute resolution) shall survive.
We may modify these Terms at any time. We will notify you of material changes via email and/or a prominent notice within the app at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your subscription.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Domana, Inc. regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
